What is the process required to create these new districts?

The School District Organization Act of 1992 (Colorado Revised Statutes, Title 22) specifically regulates the process. It is organized in the following mandated sequential steps:

  1. A petition describing the proposal to modify the school district is prepared by a Petition Committee and circulated for signature endorsements by the eligible electorate.
  2. After a successful petition campaign, a School Organization Planning Committee is created to formulate the details of the new districts. This committee is comprised of seven persons; four selected by the BVSD Board, three by the BVSD District Accountability Committee (“DAC”), and two by the Petition Committee. The statute mandates that the committee meetings be public and provides for extensive hearings and public input as part of the process.
  3. The process and details of this committee’s recommendations are reviewed by the State Commissioner of Education.
  4. The proposal defining the two new districts that results from this process is put to a public vote as a referendum.
  5. If the referendum passes, it is followed by elections for new school boards and by the creation of management groups for each district.
